Winsum Acres - Boarding, training, lessons, horses for sale, paint stallion

1. Owner agrees that the Manager, Winsum Acres (farm) their agents and employees are not liable for death, sickness and or accident, including consequential damages, caused to the horse, except if caused by the willful and wanton gross negligence of the Manager. In addition, Owner agrees to hold Manager/Farm completely harmless and not liable for any injury whatsoever caused to the Owner, Owner's horse and/or the loss or damage to person(s) accompanying Owner or personal property. Manager/Farm will not be responsible for horses who escape from stable. Owners will be responsible for any injuries inflicted upon any persons and/or damage done to facility.

2. It is the responsibility of the Owner to carry full and complete insurance coverage on Owner, Owner's horse and all personal property.

3. Owner shall pay the Manager/Farm for boarding services (prices are subject to change with a 10 day written notice), as described below, the Out side fee of $_____ Per Month or $____ Per Day/ Full Care fee of $_____ Per Month of $_____ Per day. 4. The Boarding Fee is due on the first (1st) of the preceding month, timely payments are strictly followed. A late fee of $5.00 per day will be charged on payments more than 5 days late. A finance charge of 2% (18% annually) will be charged for all payments over 30 days late. In the event that the payment is overdue by 60 days, Manager is entitled to a lien against the horse and/or personal property for the amount due, including all fees incurred and shall be entitled to enforce lien and sell the horse/personal property for the amount due according to the appropriate laws of the State. A security Deposit of $_________ payable with this contract shall be refunded to Owner within Thirty (30) days of the completion of this contract. Owner will be liable for all Court costs and Attorney's fee to collect debts owed. (All damages don by horse shall come out of the security deposit).

5. The horse(s) shall be free from infection, contagious or transmissible diseases. The following are required from Licensed Veterinarian: _______ current coggins test for animals out of State, ________Veterinarian Health Certificate, _______Worming/Vaccination Records. Manager reserves the right to refuse horse within seven (7) days of arrival if not in proper health. Fees are Non-Refundable.
